Dear Editor,
NO MATTER what the
commenters in Sabahkini.net say, all
sabah natives will lose their native identity on conversion to Islam and practically
is a 'Malay' because they can only be subjected to Syariah Court and are the
Native Courts or Mahkamah Anak Negeri are forbidden to hear any cases coming
from them.
And this order has been
issued since 28th February 1995, as the copy of this letter from the Land and
Survey Dept shows. (this copy is photographed from the wall just outside the
Penampang Native Court)
This memo signed by the
former Director Mohamad b. Jafry clearly stated that "Permohonan Jadual
Satu bagi Pembahagian/Tuntutan waris harta pusaka bagi orang-orang beragama
islam yang lazimnya dibuat dibawah ordinan harta pusaka Anak Negeri dan Harta
Kecil 1941 tidak harus diproses lagi, termasuk juga proses pendaftaran perintah
dalam format form jadual tiga yang dikeluarkan oleh Mahkamah Anak Negeri
sejauhmana ia melibatkan harta pusaka orang-orang islam."
On discussing this issue
with a Ketua Anak Negeri just yesterday, he informed me that lots of natives
who converted did so without knowing the full implication of them losing their 'Adat
Pusaka' and no matter how they regretted afterwards, it is already too late.
This KAN whose identity I
wont reveal to protect him from being victimised also informed me that he has a
cousin who had converted and after dying, his 50 acres of property still is not
released by the Syariah courts after years and probably becomes their property
since some of the children did not covert with him.
The KAN also confirmed that
75% of the property will be retained by the Syariah courts and only 25 % will
be given to the non-moslem children.
He concluded in disgust that
by converting to islam, you would only be making the syariah court and their
masters richer from your properties.
No wonder this issue has not
been discussed in public being covered up by the disguise of 'religious
sensitivities' just as it was harped to me by commenters in sabahkini, such as
Nundaring and Azraglee.
So the ordinary folks just
have to shut up and put up with the bullshit otherwise they be threatened with
the 'Anti-Islam' label and then prosecuted?
THIS is the proof that all
natives of Sabah who converts to islam ceased to be a native as they no longer
enjoy the services of the Mahkamah Anak Negeri.
Worse still, those who
remained faithful as a true native of Sabah would still be forced to accept
islamic bullshit.. for example, what if I want to sue another native for
violating my native rights but he then convert to islam?
I wont be able to bring him
before the native courts but instead I have to submit myself the the syariah
courts? Definitely the syariah courts
will be given previleges to hear the case and since non moslem lawyers are also
not allowed by the syariah, so definitely I as a non-moslem native is clearly
discriminated.
So all of you Kadazans,
Dusuns, Muruts or Rungus who have converted can forget about being a Sabah
native and now YOU can have the previleges of calling yourself MALAYS.
As for Dompok who proudly
announced the construction of 5 native court buildings around the state, one of
course is being built near the Penampang district office, well he can claimed
that the native court is now institutionalised.
That is only in his dreams.
After all, if the majority
of the natives are converted by hook or by crook, the Mahkamah Anak Negeri will
be of no used and the Logo of the Buildings can easily be changed to Mahkamah
Syariah.
Goodbye to all non-moslems,
you will soon be an extinct species so long as the ARTICLE 1 of the 20 points
cannot be reinstated into the state and federal constitution.
