SIAPA ‘JOKER’? JPN ATAU OKK WILLIAM?

SEORANG saksi dari Jabatan Pendaftaran Negara memberitahu Hakim Mahkamah Tinggi Sandakan, Y.A Tuan Lee Heng Cheong bahawa bangsa sebenar mendiang Kwan Ah Hee adalah Cina Hokkian; menimbulkan spekulasi siapa sebenarnya ‘Joker’ dalam krisis Identiti Anak Negeri.

Tuan Haji Bahrin Bin Mojitar @ Manjitar yang disapina supaya hadir memberi keterangan bagi membantu mahkamah mengadili kes guaman di antara Gabungan Saga Sdn Bhd melawan Kwan Ngen Wah dan Kwan Ngen Chung, dalam kenyataan bersumpahnya berkata demikian setelah disoal oleh Peguam Plaintif, Tuan Haji Ansari Abdullah.

Kwan Ah Hee adalah bapa kandung kepada dua jutawan, antara yang terkaya di Malaysia iaitu Kwan Ngen Wah dan Kwan Ngen Chung; defendan dalam kes yang dibicarakan.

Kwan Ah Hee bersama beberapa anaknya memiliki Sijil Anak Negeri yang melayakkan mereka membeli tanah di bawah syarat ‘Native Title’ (NT).

Sebelum ini, Ketua Daerah Kota Kinabalu, OKK William Majinbum mengesahkan bahawa Sijil Anak Negeri yang dikeluarkan kepada dua jutawan tersebut adalah sah berdasarkan ‘tandatangan’ yang terdapat di sijil berkenaan sekalipun Doket dan Fail kes permohonan sijil berkenaan hilang atau dihilangkan.

Krew Sabahkini.net yang hadir sepanjang perbicaraan mencatatkan soalan yang dikemukakan dalam bahasa Malaysia dan dijawab juga dalam bahasa Malaysia kemudian dialih kepada bahasa Inggeris oleh penterjemah Mahkamah; antaranya seperti berikut:

Hj. Ansari: What is your post in the National Registration Department?

Hj Bahrin: I am an Assistant Registrar Death and Birth of National Registration Department Kota Kinabalu.

Hj. Ansari: Your colleague Encik Bakri bin Yusof PW3 had informed this Court that the proper officer who can explain the discrepancies in exhibit D1 and P3 would be someone from your section. Did you receive a letter on the different particulars as to the race in two different death certificates relating to the late Kwan Ah Hee?

Hj Bahrin: Yes. D1 – Late Registration of Death certificate issued to Kwan Ah Hee stated the race of the deceased is Sino native where the race was wrongly entered to the race column. This mistake happened because of the one police report lodged by Khoo Tau Guan stated that the deceased was Sino Kadazan also in the late registration form also stated Sino Kadazan.

The actual fact according to the record of Identity Card of the deceased the actual race stated Chinese Fookkien. When we further examine the actual race stated is Chinese as stated in P3.

For information, the first Death Certificate that we issued stated the race of the deceased was Sino Native was a mistake. The said Death Certificate would not be accepted as a valid document due to the reason that the Death Certificate state late registration and have to be certified by 1^st Class Magistrate in accordance with Birth and Death Ordinance CAP123 S22 (3).

Hj. Ansari : Did you bring the documents contained in the file relating to the death certificate of the late Kwan Ah Hee?

Hj Bahrin: Yes. An application form and police report.

Hj. Ansari: Apply for this document to be marked as exhibit .

En. Siew: No Objection

Puan Zaleha: No Objection.

Hakim : Application form dated 9/5/2007 and police report dated 8/5/2007 are collectively marked as exhibit P13(a) –(f).

Hj Ansari : As the Assistant Registrar of Death and Birth of Sabah, can you confirm to the Court what race does the word “Sino” connote?

Hj Bahrin: “Sino” means the result of mixed marriage between Chinese and any

other races.

Hj Ansari: What does the word “native” connote?

Hj Bahrin: “Native”. Our department does not ascertain whether some one is a native or bumiputra. May be the native Court can decide that.

Hj Ansari: Does your department accept the word “native” to be used for race in an application for birth and death certificate?

Hj Bahrin: Yes.

Dalam perbicaraan sebelum sambung bicara pada 15 Julai 2010 ini dijalankan, Mahkamah telah juga dimaklumkan suku bangsa anak-anak mendiang Kwan Ah Hee ia itu Kwan Ngen Wah dan Kwan Ngen Chun ini adalah berbangsa Cina.

Apabila ditanya bagaimana sijil mati di mana bangsa mendiang Kwan Ah Hee dicatat sebagai ‘Sino Native’ boleh dikeluarkan, Haji Bahrin menyatakan ianya satu kesilapan dibuat berpandu kepada satu laporan polis yang dikemukakan oleh seorang bernama Khoo Thau Guan.

Tujuan laporan polis itu adalah untuk memohon mendapatkan Sijil Mati Daftar Lewat.

Bagaimanapun, menurut Haji Bahrin setelah di kemaskini dengan merujuk kepada rekod permohonan kad pengenalan oleh mendiang Kwan Ah Hee, suku bangsa sebenar Kwan Ah Hee adalah Cina Hokkian.

Ditanya mengenai status sijil mati yang mencatatkan bangsa mendiang Kwan Ah Hee sebagai Sino Native yang dikeluarkan Hj Bahrin menjelaskan ianya tidak sah kerana tidak diendos oleh Majistret.
