STAR CITY COMPLEX DELAYED?

A GROUP of concern shop unit buyers of the ‘Star City’ shopping mall had approached the Kota Kinabalu Member of Parliament Hiew King Cheu for assistance to deal with the alleged long overdue completion and handing over date of the building under construction in heart of the Kota Kinabalu City.

They told the KK MP Hiew that they are suffering from serious financial burden and losses incurred by the late completion and handing over of the shopping lots that they have purchased. They also said that the work now is at a stand still, and there is no work carried out on site for quite sometime now.

The buyers also claimed that their banks are still deducting from their loaned money, and paying constantly to the developer even though that there is no work done. This can be proven from the actual site condition compared to the architect’s work progress certificates on approval of payments. For example, the certificate stated that there are walls built, but in fact there are no walls.

The buyers told Hiew that they can not afford to wait any longer, and judging on site they really don’t know how long further they have to wait on. The completion date set in the agreement is already long over and the building is only half finished.

Although there is a compensation clause set in the Sale and Purchase agreement, they said this is not what they wanted. They want the completed units to be handed over to them without further waiting and to get their business started soon.

MP Hiew told them, this would need the corporation from all the buyers who are involved to effectively get the thing moving again. He would suggest them to immediately get organized and form a “Buyers Committee”. The committee then can act under their instructions and authorizations to deal with the matter. The committee can also seek legal advice from lawyers to deal with the situation to legally protect the rights of the buyers.

Hiew mentioned that his office can assist to arrange a meeting based on the mutual consent between the buyers, architects, engineers, developer, contractors, banks and DBKK to discuss on all the necessary matters arising on the stop work of this building development. He said to get the building going needs the efforts and corporations from all quarters, and he wished the problem can be solved amicably without having going to court.

Hiew also urged the concerning parties to contact his office for the said meeting arrangement. There are a few hundred of shop unit buyers, and therefore some extra time is necessary. Once the date, time and venue are fixed, this will be advertised in the news paper to inform every one.

  10. jika saya salah sorang dari pembeli2 ini, sudah tentu saya juga akan melakukan tindakan yang sama. kalaupun ada apa2 masalah yang tidak dapat dielakkan, sekurang2nya tampil lah buat penjelasan..
